Waiver & Release of Liability

Assumption of Risk

I understand that participation in boating and water-based activities — including but not limited to transportation by vessel, snorkeling, swimming, and interacting with marine life — carries inherent risks:

• Slipping, tripping, or falling while boarding, disembarking, or moving on the vessel
• Injuries due to vessel movement, rough seas, or unexpected weather conditions
• Collision with objects or other vessels
• Risks associated with swimming and snorkeling, including drowning
• Encounters with marine life (including fish, turtles, pigs, and other wildlife)
• Seasickness, dehydration, sun exposure, or fatigue
• Injuries from equipment or activities conducted on or around the vessel

I acknowledge that these risks may result in serious injury, illness, property damage, or death.

Swimming & Participation

I confirm that I am able to swim or voluntarily choose to participate in water activities at my own risk. I understand that life jackets may be provided and available upon request. I accept full responsibility for any minors under my supervision and ensure they follow all safety instructions provided by staff.

Medical Acknowledgement

I understand that medical facilities and immediate medical care may not be readily available while at sea. In the event of illness or injury, treatment may be delayed until transportation to a medical facility is possible.

Health & Safety Conditions

I acknowledge that I am physically fit to participate and assume all responsibility for my health during the experience, and that I am not:

• Pregnant
• Suffering from neck, back, or heart conditions
• Under the influence of drugs or excessive alcohol
• Physically unable to safely participate in boating or water activities

Release of Liability

I hereby release, waive, discharge, and hold harmless Bahamas Water Toys & Tours, its owners, employees, captains, crew members, affiliates, contractors, and agents from any and all liability, claims, demands, damages, or causes of action arising out of or related to personal injury, death, property damage, or participation in any activity associated with the tour, including claims resulting from negligence.

Alcohol & Conduct

I acknowledge that participation while under the influence of alcohol or drugs increases risk. I agree that Bahamas Water Toys & Tours is not responsible for any incidents, injuries, or damages resulting from such conditions.

Indemnification

I agree to indemnify and hold harmless Bahamas Water Toys & Tours from any claims, damages, or expenses (including legal fees) arising from my participation or actions during the tour.
